Terms of service

These terms ("Terms") govern your access to and use of the Munch Prep platform, including our marketing site, brand and kitchen dashboards, APIs, and related services ("Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Please also read our Privacy policy. If you are a consumer buying from a brand that uses Munch Prep, that brand's own terms and policies may apply to your purchase.

Who may use the Services

You must be at least 18 (or the age of majority where you live) and able to form a binding contract. If you use the Services on behalf of a company or organisation, you represent that you have authority to bind that entity, and "you" includes that entity.

Accounts and access

You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly at info@munch-prep.com if you suspect unauthorised use. We may suspend or terminate access where we reasonably believe there is a security or abuse risk.

The Services

Munch Prep provides software and infrastructure to help meal prep brands run storefronts, take orders, and coordinate fulfilment. Features may change over time. We do not guarantee uninterrupted or error-free operation. We may perform maintenance that temporarily affects availability.

Your content and responsibilities

You retain rights in content you submit (such as menus, images, and copy). You grant us a licence to host, use, process, and display that content as reasonably necessary to provide the Services. You represent that you have the rights needed to submit such content and that it does not violate applicable law or third-party rights.

You will not misuse the Services, including by attempting to gain unauthorised access, interfering with other users, distributing malware, or using the Services in violation of law. You are responsible for your compliance with food safety, labelling, marketing, consumer, and tax rules that apply to your business.

Orders, payments, and third parties

Checkout and payment processing may be provided by third parties (such as Stripe). Their terms and privacy policies may apply to payment transactions. Munch Prep is not the seller of record for your customers' purchases from your brand unless expressly stated otherwise in a separate agreement.

Fees

If we charge fees for the Services, the applicable pricing and billing terms will be presented to you separately (for example in-product, in an order form, or by email). Unless stated otherwise, fees are non-refundable except where required by law.

Intellectual property

Munch Prep and its licensors own the Services, including software, branding, and documentation, subject to the licences granted to you. Except as expressly allowed, you may not copy, modify, distribute, sell, or reverse engineer the Services.

Disclaimer

To the fullest extent permitted by law, the Services are provided "as is" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Munch Prep and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability for claims arising out of or related to the Services in any twelve-month period is limited to the greater of (a) the amount you paid us for the Services in that period or (b) one hundred pounds sterling (£100), except where liability cannot be limited by law (including death or personal injury caused by negligence, or fraud).

Indemnity

You will defend and indemnify Munch Prep against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your products, your breach of these Terms, or your violation of applicable law, except to the extent caused by our material breach or negligence.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Services with reasonable notice where practicable. Provisions that by their nature should survive will survive termination.

Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you may have as a consumer under the laws of your country of residence.

Changes

We may modify these Terms. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we will provide reasonable notice where required. Continued use after the effective date constitutes acceptance of the revised Terms where permitted by law.
